Henrietta man arrested in child pornography production and possession case

O'Brien, 65, of Henrietta, New York, has been arrested and charged by criminal complaint with production and possession of child pornography. Attorney Michael DiGiacomo announced the case on October 5, 2026.

Because of a prior conviction involving the sexual abuse of a minor, the charges carry a mandatory minimum sentence of 15 years in prison, a maximum of 40 years, a lifetime term of supervised release, and a $250,000 fine. According to the complaint, the Monroe County Sheriff's Office Sex Offense Coordinator contacted Homeland Security Investigations in April 2026 about O'Brien, who is a level two registered sex offender in New York State.

The source says O'Brien was convicted in 1991 of Sexual Abuse in the First Degree involving the sexual abuse of a nine-year-old male victim. The complaint says O'Brien completed a change-of-address form in October 2025 changing his address from Henrietta to Vietnam, then filed another in June 2026 changing his address from Vietnam back to Henrietta.

On the June form, he listed Instagram and X accounts. The coordinator said O'Brien has engaged in a similar pattern of travel to Vietnam for several years.

Investigators say a January 2026 CyberTip from Instagram led the National Center for Missing and Exploited Children to report child pornography exchanged in a chat room called "Tom & You Gay." Instagram reported that files were received by O'Brien's account "bom4bym." Searches of that material and another account, "Tom & Jerry," recovered child pornography, nude images of O'Brien, images of a minor in a bathtub, sexually suggestive images of minor boys, and chat content indicating a sexual interest in minor Vietnamese boys. HSI also searched O'Brien's devices at Chicago O'Hare International Airport on June 4, 2026, and later executed a warrant at his Henrietta residence on September 15, 2026, where agents found photo albums containing hundreds of printed photographs from about 2013 showing apparent minors in various stages of undress and nude minors, most of whom were of Asian descent.
