Trump issues DPA determination on U.S. petroleum production, refining and logistics capacity

Trump issued a presidential determination under section 303 of the Defense Production Act of 1950, as amended, on domestic petroleum production, refining and logistics capacity. The memorandum was addressed to the Secretary of War and ordered publication in the Federal Register.

It states that any inconsistent prior memorandum, proclamation, or executive order is superseded to the extent of the inconsistency. The determination cites Executive Order 14156, issued on January 20, 2025, which declared a national energy emergency under the National Emergencies Act.

The order said inadequate energy production, transportation, refining and generation capacity create an unusual and extraordinary threat to the nation's economy, national security, and foreign policy, and leave the United States vulnerable to hostile foreign actors. Trump found that resilient domestic petroleum production, refining, and logistics capacity is central to U.S. defense readiness.

The memorandum says petroleum fuels the armed forces, the industrial base, and crucial infrastructure, and warns that without immediate federal action, U.S. defense capabilities will remain vulnerable to disruption. It identifies exploration and production, gathering and transmission pipelines, storage, and marine terminals as part of the capacity covered by the determination.

The document makes three findings under section 303(a)(5): that these capabilities are industrial resources or critical technology items essential to national defense; that industry cannot reasonably be expected to provide them in a timely manner because of constrained financing, long lead times, permitting and infrastructure bottlenecks, and supply chain limitations; and that purchases, commitments, financial support, or other action under the Act are the most cost-effective, expedient, and practical method. Trump also waived the requirements of section 303(a)(1)-(a)(6) under section 303(a)(7), saying the action is necessary to avert a shortfall that would severely impair national defense capability.
